‘Even Year Law’ ruled constitutional, sparking debate on voter turnout – CNY Central

Advocates of the law like Onondaga County Democratic Board of Elections Commissioner Dustin Czarny believes moving local elections to even-numbered years, it will increase voter turnout. “By having elections aligned to when voters are traditionally Intuned to show up and go to the polls will mean more people will vote on these local offices and we will get a government that is more attuned to the general public.”

4th Department Appellate Division ruling in favor of Even Year Election Law

For the last several; months I have been involved with litigation for the so-called Even Year Election law that moves many local offices to even year elections from odd years. Onondaga County named me in a defendant to this law and my attorney worked with the NY State Attorney General Office to defend the law. After an initial court loss in Onondaga Supreme Court in October of last year, there was a unanimous decision on the appeal in the 4th Department Appellate Division on May 7. 2025/ I am uploading that decision so followers of this page have easy access.

Governor Hochul, Speaker Carl Heastie, Leader Andrea Stewart-Cousins, Sen. James Skoufis, Asm. Amy Paulin, Attorney General Letitia James and just about every Democratic lawmaker in state government did all the heavy lifting on this. I am happy to be a small part of this apparent victory. We will see where the Court of Appeals weighs in on this matter.

Appellate Court says NY’s Even Year Election Law is constitutional, reversing lower court – Syracuse.com

“This decision is a celebration of democracy,’’ said Dustin Czarny, Onondaga County’s Democratic elections commissioner.

“This legislation will ensure more voters will vote on more offices and we will have a government that is representative of all the people of Onondaga County and New York State,’’ Czarny said.

Onondaga County election officials boot 2 Democrats from Syracuse mayor’s race – Syracuse.com

Czarny said the board’s decisions are made by equally represented Democratic and Republican staff members and election commissioners.

“One commissioner alone cannot make this decision,” Czarny said.
